1) Under the Adoption Act 1952 (West Malaysia only)

2) Under the Registration of Adoptions Act 1952 (Applicable in Sabah and Sarawak as well)
- Adoption is registered through the Social Welfare Department (JKM), not the court.
- More administrative in nature; does not fully override the birth certificate.
- Usually used in informal or relative adoptions.
General Requirements for Adoption
- The adoptive parents must be Malaysian citizens
- At least 25 years old, and 21 years older than the child
- The child must be under 18 years old
- The child must have resided with the adoptive parents for at least 2 years
- Consent from biological parents is usually required, unless waived by the court
